Terms of Service

1. Acceptance of Terms
By accessing or using BharatDCIM ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Service
BharatDCIM provides a cloud-based Data Center Infrastructure Management (DCIM) platform with features including:
- Time-of-Day (ToD) tariff-aware power billing
- State-wise tariff calculation for Indian DISCOMs
- GST-compliant invoice generation
- Tenant management and billing
- Power consumption analytics and reporting
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring the accuracy of data you enter into the platform
- Providing accurate GSTIN and business details for invoice generation
4. Billing and Payment
Subscription fees are billed monthly or annually as selected during signup. All prices are in Indian Rupees (INR) and are exclusive of GST unless otherwise stated. GST at 18% (SAC 998313) will be added to all invoices.
We reserve the right to modify pricing with 30 days advance notice. Annual subscribers are protected from price increases for the duration of their billing term.
5. Data Accuracy and Liability
BharatDCIM provides tariff calculations and billing estimates based on published DISCOM tariff orders. While we make every effort to keep tariff data current and accurate:
- Tariff data is sourced from State Electricity Regulatory Commission (SERC) orders and may be subject to change
- Fuel Adjustment Charges (FAC/FPPCA) vary monthly and may not reflect real-time changes
- The Service is not a substitute for verification against your actual DISCOM bill
- BharatDCIM is not liable for billing discrepancies arising from outdated or incorrect tariff data
6. Invoice Generation Disclaimer
Invoices generated by BharatDCIM are created based on configurations and data provided by you. It is your responsibility to ensure:
- Correct GSTIN and business details for all parties
- Accurate consumption and billing data
- Compliance with applicable GST filing requirements
- Proper e-invoice registration with IRP where required by law
BharatDCIM is a billing tool and does not provide tax, legal, or accounting advice. Consult a qualified chartered accountant for GST compliance matters.
7. Intellectual Property
All content, features, and functionality of BharatDCIM are owned by BharatDCIM and are protected by applicable intellectual property laws. You retain ownership of all data you enter into the platform.
8. Data Export
You may export your data at any time through the platform's export features. Upon account termination, we will provide a reasonable period (minimum 30 days) to export your data before deletion.
9. Uptime and Support
We target 99.9% uptime for the platform. Scheduled maintenance will be communicated at least 48 hours in advance. Support is available via email during business hours (Monday-Friday, 9:00 AM - 6:00 PM IST).
10. Termination
Either party may terminate the subscription with 30 days written notice. Upon termination, your access to the platform will cease at the end of the current billing period. See Section 8 regarding data export.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
